Privacy Policy
At Yorba Linda Vineyard we strive to help our customers protect their privacy while using our services. To protect your privacy, Yorba Linda Vineyard has instituted a number of policies that give you information and control.
As a visitor to this Site, you can engage in many activities without providing any personal information. In connection with other activities, such as utilizing online or hosted Products and Services, YLV may ask you to provide certain information about yourself by filling out and submitting a form. It is optional for you to engage in these activities. If you elect to engage in these activities, however, YLV may ask that you provide personal information, such as your first and last name, mailing address (including ZIP code), country of residence, e-mail address, employer, job title and department, telephone and facsimile numbers, and other personal information. When ordering Products and Services via the Site, you may be asked to provide a credit card number. Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity. Similarly, if you wish to delete your information (pursuant to the mechanism set forth in “Updating your personal information and privacy preferences”) that is mandatory, you will no longer be able to engage in a particular activity.
When you use the Site and the Products and Services, YLV may also collect certain information about your computer to facilitate and evaluate your use of the Site and the Products and Services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, referring or exit webpages, and the Internet Protocol (IP) address of your computer. YLV also uses such information to measure traffic patterns on the Site and usage of the Products and Services. We do not match such information with any other information held by YLV unless we have your consent.
YLV has established relationships with various service providers whose services are available to you from the Site, from websites that are linked to the Site, or in connection with the Products and Services. Typically, these providers offer services that YLV customers might find useful, such as those that can be used in conjunction with Products and Services. In order to use those providers’ services, you may be required to provide personal information to the providers. Unless expressly provided to the contrary, personal information that you provide while you are visiting a provider's website will be subject to the privacy policy posted on that site, and personal information that you provide while on the Site will be subject to this Privacy Policy.
In order to reduce errors in our database, authenticate our users, prevent abuse of our Site and the Products and Services, and provide more consistent, relevant experiences to our users, we may on occasion supplement the personal information you submit to us with information from third-party sources. For example, if permitted under applicable law, we may supplement your Registration Information with address information provided by the U.S. Postal Service to qualify your information and prevent errors in our database.
How your personal information is used
YLV collects your information in order to record, support and facilitate your participation in the activities you select. If you subscribe to or register for Products and Services, for example, the information is used to register your rights, if any, to technical support or other benefits that may be made available to registered users. As another example, if you enter into a promotion, information is collected to qualify the entry and to contact you regarding the promotion or awards. Your personal information is also used to track customer preferences and keep you informed about product upgrades, special offers, and other products and services of YLV and selected third parties unless you have opted not to receive such communications or such communications are prohibited by law. YLV also collects your information to enable us to process, validate and verify service requests; To provide advertisers with aggregate--never individual--information about our registrants and aggregate usage patterns; To give our own Web site designers information that's useful for developing new features and services that meet registrants' needs; To allow us to potentially vary the advertising that registrants see based on their volunteered preferences; and/or To tailor the registrant's experience on our site, showing them content we think might interest them or altering the content according to their preferences.
YLV may collect information about the use of the Products and Services and the Site, such as the number of downloads, types of Services used, how many users we receive daily, and the IP/Internet address of your computer. This information is collected in aggregate form, without identifying any user individually.
YLV may use this aggregate, nonidentifying statistical data for improving the Site and the Products and Services, providing more relevant experiences to our customers and for statistical analysis.
YLV recognizes and appreciates the importance of responsible use of information collected on the Site and in connection with the Products and Services. YLV will respect your legal rights regarding access to and correction and deletion of your personal information. YLV may communicate information to you regarding products, services, and special offers available from YLV or selected third parties unless you have opted not to receive such communications or such communications are prohibited by law, although we may find it necessary to continue to communicate with you regarding your use of the Site and the Products and Services. Except in the particular circumstances described in this Privacy Policy, YLV will not provide your name to other companies or organizations without your consent.
There are other instances in which YLV may divulge your personal information, such as where required by law, regulation, or litigation. We may also disclose information about you if we determine that such disclosure should be made for reasons of national security, law enforcement, or other issues of public importance.
Protection of your personal information
The personal information that you provide in connection with registering yourself as a user of the Site or of the Products and Services is classified as Registration Information. Registration Information is protected in several ways. Access by you to your Registration Information is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. Registration information may be used in several ways: If you "opt out" we will not send you unsolicited advertising or direct mail, but if you choose to do so, you may provide us with information about your interests and allow us to contact you regarding products or services that may interest you. The "opt out" choices are made available during each individual registration process. We do use return e-mail addresses to answer the e-mail we receive, but such e-mail addresses are not used for any other purpose and are not shared with third parties. Yorba Linda Vineyard may share aggregate statistical information gathered from the registration process with advertisers, business partners, sponsor or other third parties, but none of them receive individual identifying information about you collected at our site. For example, we may tell an advertiser that X number of visitors visited a certain area on a Web site or that Y number of men and Z number of women filled out registration forms, but we would not disclose anything that would identify those individuals. We share this information only on an aggregate, anonymous basis and never on an individual basis.
Personal information may be collected by Yorba Linda Vineyard when visitors voluntarily provide this information. All such personal information is retained by Yorba Linda Vineyard and is not sold or otherwise transferred outside the company unless we obtain the user's express consent to do so or if we are required by law or by court/governmental order to disclose such information in a particular circumstance. Yorba Linda Vineyard sometimes also use e-mail addresses and other personally identifying information to contact visitors who communicate with us. For example, we direct e-mail to visitors who provide us with their e-mail addresses for specific purposes such as receiving our e-mail newsletters/updates. Each e-mail newsletter or bulletin contains instructions on how to discontinue receipt of the newsletter or bulletin.
Personal information that you provide that does not constitute Registration Information also resides on secure servers and is accessible only to selected YLV personnel and contractors via password and other suitable security controls. Since this information is not accessible online by you, you will not be asked to select a password in order to view or modify such information.
Please note that any information you post to a public bulletin board or chat room, such as the YLV User to User Forums, testimony or blogs (“Forums”), is available to all persons accessing that location, and your e-mail address may also be posted on these venues. The information you share, including your email address, would then be available to all persons accessing these venues, and such information may be read, collected or used by others for any purpose, including sending you unsolicited messages. YLV is not responsible for any information you elect to submit in these venues or the use of such information. In addition, you should be aware that the Forums offer a service in which subscribers are e-mailed a copy of all messages posted to the Forums on a particular topic. Consequently, if you post a message to the Forums, your e-mail address will be sent to those subscribers who have indicated an interest in the topic of your message.
Data not collected on this Site or in connection with the Products and Services
Personal information that is not collected on the Site or in connection with the Products and Services is not generally subject to this Privacy Policy. However, personal information submitted on physical registration cards is classified as Registration Information and is subject to this Privacy Policy. If you wish to access and/or correct such information, please see instructions for doing so in the section entitled "Updating your personal information and privacy preferences" on the Site.
Cookies
The Yorba Linda Vineyard service uses cookies. We use cookies to deliver content specific to your interests, and to recognize you when you visit our service. Your browser offers so-called "cookies", which--if you allow their use--store small amounts of data on your computer about your visit. Cookies assist us in tracking which of our features you like best. And when you re-visit, cookies can enable us to customize our content according to your preferences. However, cookies tell us nothing about you personally unless you specifically give us additional information.
We do not use cookies to identify, monitor or track any personally identifiable information. Our cookies in and of themselves do not contain any personally identifiable information about you. We do not merge or associate our cookie information with any personally identifiable information obtained by us or from third parties.
In order to improve our Products and Services and the Site and provide more convenient, relevant experiences to our customers, we and our vendors may use "cookies", “web beacons”, and similar devices to track your activities. A cookie is small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card and enables YLV to record your passwords, purchases, and preferences. It cannot be executed as code or deliver viruses. A web beacon is a small transparent gif image that is embedded in an HTML page or email used to track when the page or email has been viewed. A similar device may be used by which a Product and Service may send data to a server when a set of user-initiated events occur such as the “Add to Cart” button is clicked. This device is similar to a cookie in that it tracks your visit and the data can only be read by the server that receives the data. It is different than a cookie in that it is not browser-based, may not function as an identification card, and does not store any data on your computer.
While YLV uses cookies and similar devices to track your use of the Site and the Products and Services, such as the number of downloads, types of Products and Services used and downloaded, how many users we receive daily, and our web servers automatically log the IP/Internet address of your computer, YLV does not generally use this information to identify you personally. However, if you expressly provide consent for the Site or the Product and Service to "remember" the unique identifier that you select when you register for various activities on the Site or the Products and Services, that unique identifier will be stored on a cookie on your computer and that unique identifier will be linked to your Registration Information. As a result, your navigation path around the Site and the Products and Services will be tracked.
Some Products and Services allow the tracking of access to or use of Products and Services by users, as opposed to YLV. For example, certain Products and Services allow document authors to restrict access to documents, track access to or use of those documents, or involve communications and transmission of data over the Internet to verify the authenticity of documents, authors and recipients. Some Products and Services require activation, which tracks information including installation rights and number of installations
You also have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. However, if you reject some or all cookies, your experience at our site and on other sites throughout the World Wide Web may not be complete. Some sites require cookies to function, such as those with e-commerce features. In addition, if you do not allow cookies, you will not be able to take advantage of personalized content delivery offered by us. Most browsers are initially set to accept cookies, and most Products and Services that include similar devices are typically initially activated to collect data.
IP Addresses
An Internet Protocol (IP) address is a number assigned to your computer whenever you surf the Web. An Internet Service Provider randomly assigns the IP address at the time of dial-up. For other local area network (LAN) or cable modem users, the IP address may be permanently assigned to a particular computer or other device connected to the network. Anytime you connect to a site on the Internet, the computers communicating with each other exchange IP addresses. IP addresses can tell things like what part of the world you're connecting from, or which Internet Service Provider you are using.
We collect IP addresses for system administration and to report aggregate information. We may use your IP address to: Help diagnose problems with our servers; Administer our/your Web sites; Help identify your Internet service provider; or Gather broad, anonymous information.
We do not link IP addresses to anything personally identifiable, which means that a user's computer session is logged, but the computer user remains anonymous. Some services we may offer, such as chat rooms or forums may from time to time display the participant's IP address along with the message poster's user name (which may be real or fictional by choice).
Other Information
Through our technology, we also collect and accumulate other anonymous data that helps us understand and analyze the Internet experience of our visitors. For example, we accumulate visitor data relating to the type of browsers used, types of modems, modem speeds, operating system software (e.g. Windows 95 vs. 98), screen resolutions, color capabilities and JavaScript enabling. None of this information is personally identifiable and we only share this information in the aggregate, reflecting overall Web site or Internet usage trends.
Other Sites: This privacy policy applies only to Yorba Linda Vineyard. Users of our site should be aware that through links they could be directed to other sites that we do not control. For example, if you click on a banner advertisement or on a search result or ranked site, the click takes you off the Yorba Linda Vineyard site and sends you to a site controlled and operated by a third party. These sites may send you cookies, collect your personal information or provide offensive content. Yorba Linda Vineyard has no control over the privacy policies or practices of these other sites, and Yorba Linda Vineyard is not responsible for the privacy practices or the content of Web sites to which we link, list, rank or identify by means of a search. Yorba Linda Vineyard takes no responsibility for the products, services, policies or actions of third parties or the content of third party Web sites. In addition, Yorba Linda Vineyard will not censor or edit the content of sites on the World Wide Web. We encourage you to be aware when you are leaving our sites and to read the privacy policies of each Web site you visit and recognize that the collection and use of your personal information will be governed by the privacy policy applicable to that site. That privacy policy should identify the entity that is collecting your personal information.
Security
Our site has physical, electronic and managerial security measures in place to protect the loss, misuse and alteration of the information under our control. We use secure servers with encryption for certain transactions and confidential data. We maintain a firewall to protect data within our local area network and our servers are maintained in secured access, locked facilities.
In addition, for some of our services, you will be provided with passwords. We recommend you do not divulge your password to anyone. Yorba Linda Vineyard will never ask you for your password in an unsolicited telephone call or e-mail. You are responsible for the secrecy of your passwords.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems. You can report network abuse and any risk of security violations to us by e-mailing .
Legal Disclosures of Information
EXCEPT UNDER THE FOLLOWING CIRCUMSTANCES, YORBA LINDA VINEYARD WILL NOT SHARE YOUR PERSONALLY IDENTIFABLE INFORMATION WITH A THIRD PARTY WITHOUT YOUR PRIOR CONSENT. There are a limited number of situations where we may disclose your personal information to others without first receiving your consent: (1) when legally ordered to do so by a lawful subpoena or court order, (2) if you violate or breach an agreement with us, (3) if we believe conduct by you will harm the property or rights of Yorba Linda Vineyard or those of Yorba Linda Vineyard 's users, or (4) under exigent circumstances to protect the physical safety of Yorba Linda Vineyard , its employees, users or the general public.
Your Acceptance
By using our site, you signify your agreement to the privacy polices described above. If you do not agree with our privacy policies, please do not use our site. Your continued use of our sites following posting of changes to these privacy policies means you accept those changes.
